Em boa parte do Artigo 68 do Livro Primeiro de seu Estado e Pranto da Igreja, Álvaro Pais, O. Min. (c. 1270-1349) refuta 5 proposições com implicações políticas atribuídas a Marsílio de Pádua (1280-1342). Neste artigo, analisamos a refutação dessas proposições feitas pelo Menorita galego, comparando-as, de um lado, com os textos, efetivamente escritos pelo Médico paduano, que se encontram em sua obra Defensor da Paz (1324) e, de outro, cotejando-o com uma Epistula ad quosdam cardinales, de autoria do mencionado (...) Frade, escrita pelo menos dois anos antes. Desse estudo resultaram as seguintes conclusões: 1 – Frei Álvaro, sem fazer nenhuma alusão, apoiou-se basicamente na mencionada Epistula. 2 – Sob o aspecto doutrinal, essencialmente, não há diferença entre ambos os textos alvarinos. 3 – Nos dois textos, o Franciscano galego não compulsou o Defensor da Paz, tendo utilizado as teses que os censores dessa obra imputaram ao seu autor; em 1327, quando o Papa João XXII condenou-a como herética. ABSTRACT In a large part of the Article 68 of the Book one of his Status et Planctus Ecclesiae, Alvarus Pelagius O. Min. (c. 1270-1349) refutes five propositions, having political implications, attributed to Marsilius Patavinus (1280-1342). In this study, we analyze the refutation of these propositions made by Alvarus, comparing, on the one hand, with the texts, really, written by Marsilius, which are in his book entitled Defensor pacis (1324), and on the other hand, quoting Alvarus’ text with the Epistula ad quosdam cardinales, also written by the mentioned Franciscan friar two years before. From this study, resulted the following conclusions: 1 – Without to do any mention in the Article 68, the principal Alvarus’ source was the referred Epistula. 2 – Considering the two texts written by Fr. Alvarus, according the doctrinal aspect, they are essentially equal. 3 – In both texts we could see that Alvarus not had in his hands the Defensor Pacis, having used the thesis which the censors of this book imputed to Marsilius in 1327, when this book was condemned as heretic by the Pope John XXII. As a matter of fact, for Duns Scotus, both the property and the political authority were established by men, after the Original Fall, not by God, because they are more in consonance with the new condition of humans, marked by their bad passions. Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. Moreover, representation theorems w.r.t. constructions based on selection functions are obtained for all the operations. (shrink)

Book reviewed in this article: Protecting The Vulnerable: A Reanalysis of Our Social Responsibilities. By Robert E. Goodin. Chicago: University of Chicago Press.

Objective: To report results from a national survey of coordinators and managers of clinical research studies in the US on their perceptions of and experiences with scientific misconduct.Methods: Data were collected using the Scientific Misconduct Questionnaire-Revised. Eligible responses were received from 1645 of 5302 surveys sent to members of the Association of Clinical Research Professionals and to subscribers of Research Practitioner, published by the Center for Clinical Research Practice, between February 2004 and January 2005.Findings: Overall, the perceived frequency of misconduct (...) was low. Differences were noted between workplaces with regard to perceived pressures on investigators and research coordinators, and on the effectiveness of the regulatory environment in reducing misconduct. First-hand experience with an incident of misconduct was reported by 18% of respondents. Those with first-hand knowledge of misconduct were more likely to report working in an academic medical setting, and to report that a typical research coordinator would probably do nothing if aware that a principal investigator or research staff member was involved in an incident of misconduct.Conclusion: These findings expand the knowledge on scientific misconduct by adding new information from the perspective of research coordinators. The findings provide some data supporting the influence of workplace climate on misconduct and also on the perceived effectiveness of institutional policies to reduce scientific misconduct. (shrink)

The current article aims to provide an up-to-date synopsis of available techniques to study affect dynamics using intensive longitudinal data. We do so by introducing the following eight dichotomies that help elucidate what kind of data one has, what process aspects are of interest, and what research questions are being considered: single- versus multiple-person data; univariate versus multivariate models; stationary versus nonstationary models; linear versus nonlinear models; discrete time versus continuous time models; discrete versus continuous variables; time versus frequency domain; (...) and modeling the process versus computing descriptives. This book is less about disjunction than about the English word ‘or’, and it is less for than against formal logicians—more exactly, against those who maintain that formal logic can be applied in certain ways to the evaluation of reasoning formulated in ordinary English. Nevertheless, there are many things to interest such of those persons who are willing to overlook the frequent animadversions directed against their kind in the book, and this review will concentrate on them.

This paper explores the relationship between concepts of probability and hermeneutics. It seeks to examine the relationship between subjective (Bayesian) views of probability and hermeneutic descriptions of understanding. It is argued that Gadamer'saccount of the prejudicial nature of understanding, derived from Heidegger'sanalysis of foreunderstanding, offers a provocative model of clinical reasoning. The implications of this model for evidence-based medicine are discussed in conclusion.

Scientific authority and physician authority are both challenged by Thomas Kuhn's concept of incommensurability. If competing “paradigms” or “world views” cannot rationally be compared, we have no means to judge the truth of any particular view. However, the notion of local or partial incommensurability might provide a framework for understanding the implications of contemporary philosophy of science for medicine. We distinguish four steps in the process of translating medical science into clinical decisions: the doing of the science, the appropriation of (...) the scientific findings by the clinician, the transfer of the findings from the clinician to the patient, and the choice of a treatment regimen. Incommensurability can play a role in each stage. There is at least some theory- and value-ladenness in science that is dependent on the world view of those who construct the scientific theories. Clinicians who must use the results of scientific research will inevitably interpret the research from the standpoint of their own world view. There may be further incommensurability when these data are communicated to the patient. Finally, clinician and patient values must come into play in any decision about choice of treatment. No stage of medical research or practice is value-free. This position does not imply relativism; some scientific accounts are better than others. However, the challenge of the incommensurabilists shows that further analysis is needed to establish how particular accounts are better or worse. (shrink)

Much of the legal and social interest in new neuroimaging techniques stems from the belief that they can deliver on the materialist understanding of the relationship between the brain and the mind. This article looks at predictions about the future both of scientific advances and of social reactions to those predictions. It looks at the likely technical limits on neuroscience-based mindreading, then at the likely limits in how the law might use such technologies. It describes three kinds of technical barriers (...) to detailed and useful mindreading: the likely impossibility of making a complete and accurate model of a human brain in light of its incredible complexity, the problems of interpersonal and intrapersonal plasticity, and the problem of trying to read, now, someone's past mental state. The potential changes to the operation of the law, through the use of mindreading as evidence of pain, deception, or bias, among other things, could be extremely important. (shrink)

Background: Despite the expansion of ethics consultation services, questions remain about the aims of clinical ethics consultation, its methods and the expertise of those who provide such services.Objective: To describe physicians’ expectations regarding the training and skills necessary for ethics consultants to contribute effectively to the care of patients in intensive care unit .Design: Mailed survey.Participants: Physicians responsible for the care of at least 10 patients in ICU over a 6-month period at a 921-bed private teaching hospital with an established (...) ethics consultation service. 69 of 92 eligible physicians responded.Measurements: Importance of specialised knowledge and skills for ethics consultants contributing to the care of patients in ICU; need for advanced disciplinary training; expectations regarding formal-training programmes for ethics consultants.Results: Expertise in ethics was described most often as important for ethics consultants taking part in the care of patients in ICU, compared with expertise in law , religious traditions , medicine and conflict-mediation techniques . When asked about the formal training consultants should possess, however, physicians involved in the care of patients in ICU most often identified advanced medical training as important.Conclusions: Although many physicians caring for patients in ICU believe ethics consultants must possess non-medical expertise in ethics and law if they are to contribute effectively to patient care, these physicians place a very high value on medical training as well, suggesting a “medicine plus one” view of the training of an ideal ethics consultant. As ethics consultation services expand, clear expectations regarding the training of ethics consultants should be established. (shrink)

Continuous recordings of brain electrical activity were obtained from a group of 176 patients throughout surgical procedures using general anesthesia. Artifact-free data from the 19 electrodes of the International 10/20 System were subjected to quantitative analysis of the electroencephalogram (QEEG). Induction was variously accomplished with etomidate, propofol or thiopental. Anesthesia was maintained throughout the procedures by isoflurane, desflurane or sevoflurane (N = 68), total intravenous anesthesia using propofol (N = 49), or nitrous oxide plus narcotics (N = 59). A set (...) of QEEG measures were found which reversibly displayed high heterogeneity of variance between four states as follows: (1) during induction; (2) just after loss of consciousness (LOC); (3) just before return of consciousness (ROC); (4) just after ROC. Homogeneity of variance across all agents within states was found. Topographic statistical probability images were compared between states. At LOC, power increased in all frequency bands in the power spectrum with the exception of a decrease in gamma activity, and there was a marked anteriorization of power. Additionally, a significant change occurred in hemispheric relationships, with prefrontal and frontal regions of each hemisphere becoming more closely coupled, and anterior and posterior regions on each hemisphere, as well as homologous regions between the two hemispheres, uncoupling. All of these changes reversed upon ROC. Variable resolution electromagnetic tomography (VARETA) was performed to localize salient features of power anteriorization in three dimensions. A common set of neuroanatomical regions appeared to be the locus of the most probable generators of the observed EEG changes. (shrink)

This book provides a formal ontology of senses and the belief-relation that grounds the distinction between de dicto, de re, and de se beliefs as well as the opacity of belief reports. According to this ontology, the relata of the belief-relation are an agent and a special sort of object-dependent sense (a "thought-content"), the latter being an "abstract" property encoding various syntactic and semantic constraints on sentences of a language of thought. One bears the belief-relation to a thought-content T just (...) in case one (is disposed as one who) inwardly affirms a certain sentence S of one’s language of thought that satisfies what T encodes, which in turn requires that S’s non-logical parts stand in appropriate semantical relations to items specified by T. Since these items may include other senses as well as ordinary objects, beliefs of arbitrary complexity are automatically accommodated. Within the framework of the formal ontology, a context-dependent compositional semantics is then provided for a fragment of regimented English capable of formulating ascriptions of belief—a semantics that treats substitutional opacity as a genuine semantic datum. Finally, the resulting picture of belief and its attribution is defended by showing how it solves standard puzzles, avoids objections to rival accounts, and satisfies certain adequacy conditions not fulfilled by traditional theories. Along the way, clarification and defense is offered for the ingredient conception of object-dependent senses, and it is shown how adoption of the language of thought hypothesis permits Bertrand Russell’s obscure doctrine of logical forms to be understood in a way that not only vindicates his Multiple Relation theory of de re belief but also reveals the connection between these logical forms and thought-contents. The last phase of Greek philosophy has until recently been less intelligently studied than any other, and in our understanding of its development there are still lamentable lacunae. Three errors in particular have in the past prevented a proper appreciation of Plotinus' place in the history of philosophy. The first was the failure to distinguish Neoplatonism from Platonism: this vitiates the work of many early exponents from Ficinus down to Kirchner. The second was the belief that the Neoplatonists, being ‘mystics,’ (...) were necessarily incomprehensible to the plain man or even to the plain philosopher. To have encouraged the persistence of this superstition in the nineteenth century is the least pardonable of Creuzer's many sins. The third was the chronological confusion involved in the ascription to Saint Paul's contemporary of the works of the pretended Dionysius Areopagita, which contain a fully-developed Neoplatonic theology. Though the fraud had been exposed by Scaliger, these writings continued down to the beginning of the nineteenth century to be used as evidence that the ‘Nsoplatonic trinity’ was an inferior imitation of the Christian one. When this false trail was at length abandoned the fashion for orientalizing explanations persisted in another guise: to the earliest historians of Neoplatonism, Simon and Vacherot, the school of Plotinus was ‘the school of Alexandria,’ and its inspiration was mainly Egyptian. Vacherot says of Neoplatonism that it is ‘essentially and radically oriental, having nothing of Greek thought but its language and procedure.’ Few would be found to-day to subscribe to so sweeping a pronouncement; but the existence of an important oriental element in Plotinus' thought is still affirmed by many French and German writers. We give a tensor formulation of synchronization transformations within special relativity in order to bridge the gap between some philosophical discussions (e.g., by Grünbaum and Winnie) and the analyses given by physicists (e.g., Møller). As an application, we discuss a physical interpretation of the duality between covariant and contravariant indices in the tensor formulation.

The purpose of the present article is to examine the use of Logos as an ontological term in the Plotinian system and to seek to trace its connexion with Stoicism. Although at first the fact that the fundamental meaning metaphysically of Logos for Plotinus is a spiritual activity due, both as created and as creator, to the desire for contemplation may appear to be an obstacle to a close resemblance with the Spermatic Logos of Stoicism, the creative aspect of the (...) elemental Fire, nevertheless abundant and striking similarities in other respects seem to furnish conclusive evidence that the title which I have selected is not mistaken. The full importance of the Plotinian Logos cannot indeed be grasped until the development of the term has been studied not merely in Stoicism but in Philo and early Patristic Literature; for then the common function of Logos in every system, the reconciliation of the transcendent and the immanent views of God, is clearly manifested. But here only a brief indication of the evolution of the Logos doctrine between the diffusion of Stoic thought and the emergence of Neoplatonism is possible. Chief interest will be directed to the use by Plotinus of the spermatic conception, fundamentally Stoic, of a creative Nature which informs and pervades the Cosmos as its immanent Logos. (shrink)
